of an ultralight aircraft crash at Black Point near Cervantes on the West Australian coast.

WA Police and the Fire and Emergency Services Authority (FESA) said the RAC rescue
chopper was sent just before 10am (WST) but no further information was immediately available.

SYDNEY, Dec 16 AAP - Video footage shows Christopher Scott Corben at an exclusive Sydney
nightspot in the company of a woman, hours before he allegedly sexually assaulted her
in the bathroom.

The 31-year-old from Lilli Pilli is facing two counts of sexual assault relating to
alleged events at the Piano Room in Kings Cross in October 2008 and at Sydney's Ivy bar
in October 2009.

On both occasions Corben is alleged to have assaulted the women in the bathrooms of the venues.

The management consultant denies the charges.

At Sydney's Downing Centre Local Court on Thursday a hearing began before Magistrate
Caleb Franklin to determine what evidence can be used at an upcoming committal.

Crown Prosecutor Kate Chater tendered four DVDs, showing CCTV footage from both venues
and "walk-throughs" with both victims.

"There is CCTV from the scene of both offences," Ms Chater told the court "... from
the Piano Room ... there are three camera angles, one of which shows the alleged offender
and the complainant up to two hours before".

Prosecutors also made available the results of a medical examination of the second
woman, a Sydney-based fashion designer.

"We were recently served with a statement ... which alleges that no penetration took
place," defence barrister Winston Terracini said.

Corben, who is on bail, was in court where Magistrate Franklin adjourned the matter
to later on Thursday so he could view the tendered evidence.

A man allegedly at the centre of a Melbourne siege early yesterday morning will appear
in court today charged with attempted murder.

SUHAIL KHUDRUJ has been charged with two counts each of attempted murder and conduct
endangering life .. and one count of being a prohibited person in possession of a firearm.

KHUDRUJ was arrested after police were called to a factory in Sunshine about 4.20am
(AEST) yesterday .. following reports of a disturbance and shots being fired.

He'll appear in the Melbourne Magistrates Court today.

In a world first .. tagged Great White sharks swimming along Perth's popular beaches
will trigger an alert by email or SMS to mobile phones to relevant authorities.

The West Australian government will use satellite receivers along the state's coast
to allow real-time tracking of the most feared creature in the ocean.

About 100 sharks will be tagged in a two-year study to measure the movements and migration
patterns of white pointers along the metropolitan coast.

PERTH, April 7 AAP - Fortescue Metals Group boss Andrew Forrest and his executives
did not mislead investors by overstating agreements with Chinese parties, a court has
heard.

The Australian Securities and Investments Commission (ASIC) alleges the Pilbara iron
ore miner made misleading and deceptive statements about the nature of deals with three
state-owned Chinese companies in 2004.

On the second day of a five-week hearing, Fortescue's lawyer John Karkar, QC, said
Mr Forrest and his executives were entitled to conclude binding agreements had been entered
into.

The agreements required further negotiation and a commercial outcome was never reached.

"We say in the end, having regard to what happened, investors were not misled," Mr
Karkar told the Federal Court in Perth on Tuesday.

The financial market understood the agreement with China Railway Engineering Corporation
(CREC) "to be conditional" on completion of certain studies, although this information
was not included in an August media release, Mr Karkar said.

He said the validity of the announcement was reinforced by the fact CREC had not only
reviewed the draft version, but also made amendments.

"The announcements were approved by CREC.

"There can be no question that CREC participated in approval of the media release in
the form that it was."

Mr Karkar said CREC had been keen to convert the agreement into a memorandum of understanding
(MoU), but it felt rushed as the transaction first needed to be approved by Chinese regulators.

"Interest ... came from the Chinese. The evidence to that effect is overwhelming," he said.

Citing several media reports, Mr Karkar said the common investor would have taken the
commentary into account.

"In short ... the media thought the announcements were light on detail," he said.

"We would submit the common investor with knowledge of the facts would understand that
plans for the project were in their infancy and that Fortescue's achievements had hitherto
been preliminary.

"That is the context in which the announcement about binding ... contracts were made.

"We say, in the end, having regard to what happened, investors were not misled."

Mr Karkar said it was common knowledge the framework deals would be supplemented with
further agreements.

This was because media reports and analyst research - issued prior to the announcements
in question - had described Fortescue's project as being in the early stages with many
milestones ahead.

Mr Karkar said if necessary Fortescue could demonstrate the contracts to build and
finance various parts of the project's infrastructure were regarded as binding.

But neither Mr Forrest nor the other directors were lawyers and "no reasonable layman
would be expected to know the intricacies of the law of contracts", he said.

He said the seven per cent jump in Fortescue's share price that followed the company's
August 23, 2004 announcement was not "statistically significant".

Fortescue and Mr Forrest face maximum civil penalties of $6 million and $4.4 million,
respectively, if the action is successful.

A 12-year-old girl has died and a man is in a critical condition after a single-vehicle
crash on the Sunshine Coast.

Police say the vehicle with three people inside hit a concrete pylon at Caloundra this afternoon.

The girl died in an ambulance on the way to Nambour hospital.

The 47-year-old male driver was flown from Nambour hospital to Brisbane with life threatening
internal and head injuries.

A 47-year-old woman is in a stable condition at Nambour hospital with internal and
spinal injuries.



The accident brings the state's holiday road toll to two.

SYDNEY, Dec 3 AAP - Could a backyard barbecue and children's birthday party end up
being the last public appearances Kim Beazley makes as federal opposition leader?

The low-key events provided a much-needed break for Mr Beazley, who spent most of today
in his Sydney office frantically phoning colleagues ahead of tomorrow's leadership showdown
with Kevin Rudd.

After a quick take-away lunch of chicken teriyaki washed down with a Diet Coke, Mr
Beazley and wife Susie Annus escaped to the well-heeled eastern Sydney suburb of Woollahra.

Waiting for them was a crowd of supporters squeezed into the backyard of Janine Young,
daughter of Mr Beazley's mentor and former Hawke government minister Mick Young.

Despite being in the middle of a battle to save his political career, Mr Beazley was
determined to honour Ms Young's invitation to her backyard barbecue for the Mick Young
Scholarship Trust.

But before he even walked in the door, Mr Beazley had a few quick words with the media
pack waiting in a park opposite.

Having expressed his confidence at winning the leadership ballot, Mr Beazley spied
a children's party and marched over to congratulate the birthday boy, four-year-old Shaun
Mitterlechner.

Shaun and his young friends mobbed Mr Beazley, although possibly only because they
realised they could be on the tele if they posed with the big man.

Across the road at the barbecue, the more adult crowd provided a tired looking Mr Beazley
with some much-needed words of encouragement.

Among them was The Whitlams frontman Tim Freedman, who had turned up to play a few
tunes and present Mr Beazley, as patron of the trust, with a cheque for $25,000.

The singer soon found himself urging the crowd to get behind a man he believed "deserves
to be our next prime minister".

Mr Freedman said Mr Beazley had been unlucky in the past in losing two close elections
to Prime Minister John Howard.

"I think anyone who can be that unlucky that many times has got enough ticker to be
a very good prime minister," he said.

The words weren't as kind earlier today as Mr Beazley waited at the Network Ten's studios
in Sydney to appear on Meet The Press.

As he waited, he listened to a harsh attack by fellow guest, Health Minister Tony Abbott,
who said Labor's caucus had to choose between "a proven failure" in Mr Beazley and "a
potential disaster" in Mr Rudd.

The opposition leader was also forced to put on a brave face when the program screened
an unflattering animated cartoon of him.

But once the cameras were switched off and Mr Beazley prepared to depart, he was met
by Mr Abbott, who extended an olive branch by shaking his hand and wishing him luck.

A Portuguese fisherman is being rushed to Australia in a critical condition after being
rescued from sub-Antarctic waters.

Australian Customs says the 46-year-old is suffering from a burst duodenal ulcer with
numerous complications.

He was aboard a Spanish-flagged fishing ship, the Arnela, near the remote Heard and
McDonald islands when he fell ill.

Australian Customs and Fisheries were called to his aid last Thursday.

Officials say the vessel carrying him, the Oceanic Viking, is expected to arrive into
Fremantle on Christmas Eve.
